1. Agreement

These Terms of Service (“Terms”) form an agreement between you and Invsion OG, Street, City, Country (“we”, “us”), the operator of Fumely. By downloading, accessing, or using the Fumely app or this website, you agree to be bound by these Terms. If you do not agree, do not use Fumely.

2. What Fumely is — and is not

Fumely is a behavioral self-monitoring tool designed to help you observe your vaping habit and gradually increase the time between vapes at your own pace. It is not a medical device, medical treatment, or substitute for professional care. It does not diagnose, treat, or cure nicotine dependence or any other condition. Always seek the advice of a qualified health provider with any questions about quitting nicotine, especially if you are pregnant, have a heart condition, or have other health concerns.

3. Eligibility

Because Fumely concerns nicotine use, you must be at least the age of legal majority and the legal age to purchase nicotine products in your jurisdiction to use it. By using Fumelyyou represent that you meet these requirements.

4. Subscriptions, billing, and cancellation

Fumely is offered as a paid subscription. Payment is charged to your Apple ID at confirmation of purchase. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the end of the period.

You can manage or cancel your subscription at any time in your Apple ID account settings. Refunds are handled by Apple in accordance with the App Store terms; we generally cannot issue refunds directly. Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.

5. Acceptable use

• Use Fumely only for your own personal, lawful purposes.
• Do not attempt to reverse-engineer, disrupt, or gain unauthorized access to the app or our systems.
• Do not resell, sublicense, or commercially exploit the app or its content.

6. Intellectual property

The Fumely app, this website, and all related content, design, and trademarks are owned by Invsion OG or its licensors and are protected by law. We grant you a limited, personal, non-transferable, revocable license to use the app for its intended purpose. The data you log remains yours.

7. Disclaimers

Fumely is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that it will help you reduce or stop vaping. Results depend on many factors outside our control.

8. Limitation of liability

To the fullest extent permitted by law, Invsion OG will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of (or inability to use) Fumely. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Termination

You may stop using Fumely and delete your account at any time. We may suspend or terminate your access if you breach these Terms or where required to protect our service or other users. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

10. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “last updated” date above and, where appropriate, notify you in the app. Your continued use after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of Austria, without regard to its conflict-of-laws rules. Mandatory consumer-protection rights in your country of residence remain unaffected.
